Nesta quarta-feira (5), o presidente Jair Bolsonaro sancionou o Projeto de Lei Complementar (PLP) 9/2020, que autoriza a extinção de créditos tributários devidos pelas micro e pequenas empresas integrantes do Simples Nacional.
Bolsonaro anunciou a sanção durante transmissão pelas redes sociais. Ao lado dele estavam os deputados federais Marco Bertaiolli (PSD-SP) e Gutinho Ribeiro (Solidariedade-SE), além do senador Jorginho Mello (PL-SC), que relatou a matéria no Senado.
De acordo com o discurso de Bolsonaro, a medida vai ajudar a preservar empregos durante a pandemia do novo coronavírus. O projeto havia sido aprovado em julho e aguardava sanção presidencial.
“Estamos fechando basicamente o leque para manutenção de empregos no Brasil”, disse Bolsonaro durante a live.
O senador Jorginho Mello disse que o projeto vai garantir a sobrevivência dos pequenos negócios. “Isso vai de encontro a tudo aquilo que o micro e pequeno empresário sempre sonhou.”
Dívidas micro e pequenas empresas
A Secretaria-Geral da Presidência da República afirmou, em nota, que “a iniciativa tem o objetivo de autorizar a extinção de créditos tributários devidos pelas microempresas (MEs) e Empresas de Pequeno Porte (EPPs), que participam do Simples Nacional, por meio de transação resolutiva de litígio. Com isso, os créditos da Fazenda Pública, em fase de contencioso administrativo ou judicial ou inscritos em dívida ativa poderão ser extintos mediante transação.”
O projeto facilita a renegociação de dívidas dessas empresas com a União nos termos da Lei do Contribuinte Legal (Lei 13.988, de 2020).
A lei, sancionada em abril deste ano, permite ao governo fazer negociações chamadas de transações resolutivas de litígios quanto a dívidas com a União, seja em fase administrativa, judicial ou em fase de créditos inscritos em dívida ativa
O PLP prevê também a prorrogação do prazo para enquadramento no Simples Nacional para as micro e pequenas empresas. Essa prorrogação ainda será regulamentada pelo Comitê Gestor do Simples Nacional.
