GOVERNO ALTERA REGRAS DO PRONAMPE
O governo federal sancionou o Projeto de Lei (PL) nº 3.188/21, que altera as regras do Programa Nacional de Apoio às Microempresas e Empresas de Pequeno Porte (Pronampe), para facilitar o acesso ao crédito por meio das garantias com os bancos.
Além disso, o PL também dispensa todos os agentes financeiros do Pronampe da exigência de certidões de regularidade fiscal, Fundo de Garantia do Tempo de Serviço (FGTS) , Relação Anual de Informações Sociais (Rais) e outras que restringem o acesso ao Programa Emergencial de Acesso a Crédito na Modalidade de Garantia (Peac-FGI) e ao Programa de Estímulo ao Crédito (PEC). Apenas a obrigatoriedade de regularidade previdenciária da empresa tomadora permanece.
Programa Crédito Brasil Empreendedor
A sanção presidencial faz parte das iniciativas que integram o Programa Crédito Brasil Empreendedor, composto por medidas que beneficiam principalmente os micro e pequenos empresários do país.
Anunciado em 25 de abril deste ano pela Secretaria Especial de Produtividade e Competitividade (Sepec) do Ministério da Economia, o Crédito Brasil Empreendedor trouxe como principal novidade a ampliação do Pronampe aos Microempreendedores Individuais (MEIs), que representam 57% dos empreendedores brasileiros.
“O governo federal vai bancar até 80% dessas garantias, destravando os bancos e, com isso, fazer o crédito chegar a cada dono e dona de negócio do Brasil, com juros mais baixos, carência de seis a 12 meses, e, desta vez, para microempreendedores individuais”, explicou a secretária especial de Produtividade e Competitividade, Daniella Marques.
O Crédito Brasil Empreendedor inclui a Medida Provisória do Crédito, que deverá alavancar R$ 37 bilhões em financiamentos. A MP altera a legislação que disciplina diversos programas de financiamento público e acesso ao crédito em vigor: Fundo Garantidor da Habitação Popular (FGHab), Fundos Garantidores de Risco de Crédito para Micro, Pequenas e Médias Empresas e Programa Emergencial de Acesso a Crédito – Fundo Garantidor de Investimentos (Peac-FGI).
Outra medida do Credito Brasil Empreendedor foi a assinatura do Decreto nº 11.022, de 31 de março de 2022, zerando o valor do Imposto Sobre Operações Financeiras (IOF) até o fim de 2023 para o PEC, o Peac e o Pronampe.
O Fundo Garantidor de Operações (FGO), responsável por assegurar o pagamento dos empréstimos em casos de inadimplência, foi o instrumento criado pelo governo para possibilitar o oferecimento de taxas de juros mais baixas. As operações de crédito do Pronampe têm taxas de juros de até 6%, acrescidos da Selic.
De autoria do senador Jorginho Mello (PL/SC) e com relatoria da senadora Kátia Abreu (PP/TO), o PL nº 3.188/21 que estabelece a reutilização de recursos emergenciais para novos empréstimos, para contratação até dezembro de 2024, em razão da continuidade da crise, havia sido aprovado no Senado por ampla maioria (447 votos a nove).
Em 13 de abril, em regime de urgência proposto pelo deputado Ricardo Barros (PP/PR), líder do governo na Câmara, o projeto foi aprovado com duas emendas na Câmara e, por isso, voltou ao Senado.
Ainda no âmbito do projeto, uma emenda aprovada na Câmara dos Deputados também reedita o PEC, destinado à realização de operações de crédito a pessoas físicas ou jurídicas com receita bruta anual de até R$ 300 milhões. A estimativa é que, com essa reedição, sejam contratados R$ 14 bilhões até 31 de dezembro de 2022.
