Muito vem se falando a respeito de uma nova obrigação acessória, criada pela Receita Federal do Brasil, para segundo eles otimizar tempo e processos, com as apurações de contribuições sociais e tributos federais.

Muito vem se falando a respeito de uma nova obrigação acessória, criada pela Receita Federal do Brasil, para segundo eles otimizar tempo e processos, com as apurações de contribuições sociais e tributos federais.
Estudando o manual da DCTFWeb, pude verificar alguns pontos, que poderão trazer um certo transtorno, caso não aja alinhamentos com os órgãos gestores das referidas contribuições Sociais, nesse caso especifico a Caixa Econômica Federal, órgão que administra os recursos depositados de empregados e entidades sindicais.
Isso me faz relembrar no inicio do Simples Nacional, e até hoje isso se perdura, o repasse que a RFB(Receita Federal do Brasil) é obrigada a fazer aos estados e municipais quando do recolhimento daquele tributo. Caso em que muitas vezes nós como Contadores e empreendedores, temos que levar a Guia DAS aos referidos órgãos para comprovarmos o pagamento e assim não estarmos enquadrados como devedores.
No manual da DCTFWeb, cita que todo fato gerador que seja transmitido pelo eSocial e pela EFD Reinf, deverá até o dia 15 do mês subsequente ao fato gerador se transmitido por tal declaração para que se gere as guias, ou melhor dizendo, a Guia de recolhimento, neste caso um único DARF em que se fará constar todos os débitos tributários e sociais da empresa, sem nenhuma distinção ou distribuição dos referidos.
Gerando assim um impacto para as empresas, que em virtude de terem que se adequar a esta nova modalidade de cálculos e apurações, deverão ter o máximo de cuidado e observância de tudo que for gerado pelos sistemas do eSocial e do EFD Reinf no SPED. Para que não ocorram em retrabalho da equipe fiscal e trabalhista.
Deve-se observar, que as empresas enquadradas no Grupo I, empresas com faturamento acima de R$ 78 milhões, que deverão entregar as suas obrigações geradas no eSocial e EFD Reinf, referente a competência agosto, que deveria ser entregue até 15 de agosto, porém, por ser uma declaração relativamente nova e que está gerando muitas dúvidas, tantos dos contribuintes quanto dos profissionais da área contábil, a RFB resolveu prorrogar a sua entrega para o mês subsequente, nesse caso até o dia 15 de setembro conforme IN da RFB 1819/2018.
Isso mostra que ainda o sistema da DCTFWeb não se encontra um sistema estável, além de não ter tido uma divulgação antecipada, através de ministração de cursos, palestras esclarecedoras, enfim tudo que compõe um bom planejamento, para um lançamento deste nível.
Além desses impasses citados, temos diversos outros, que deverão ser analisados com cautela, exemplo há um alinhamento com a CEF para baixa dos depósitos do FGTS? Será que isso não trará mais uma obrigação de termos que ir até a CEF comprovar que houve o deposito, até a CEF realmente processar os pagamentos?
Será que não haverá atrasos nesses processamentos? Essas questões que preocupam creio que os empreendedores e contadores no país inteiro. Estamos numa busca desenfreada para acertarmos a trabalhar ainda com eSocial que passou um sistema complexo e com muitas informações, teremos que nos adequar a esta nova realidade sem nem mesmo estarmos 100% prontos para o SPED. Isto digo porque vejo as dúvidas de colegas contadores, que desesperadamente buscam ajuda em diversos sites da área e fóruns, para pelo menos acertar o envio de tais declarações.
As empresas contábeis assim como os seus clientes que tendo impactos relevantes e constantes em ter que se adequar a uma nova realidade tributária no campo das obrigações sejam elas acessórias ou obrigações que fazem parte do cotidiano dos escritórios contábeis e seus clientes.
Uma obrigação como a DCTFWeb jamais poderia ser chamada de obrigação acessória (obrigação a parte) e sim deveria compor junto com o eSocial, EFD Reinf, NFe, entre outros o SPED, porque ela passa a integrar o SPED de maneira impactante e diferenciada. Se tornando mais um sistema do SPED.
